By accessing, downloading, installing, or using the HireMeUp mobile application ("App"), website ("Website"), or any related services (collectively, the "Service"), you ("User," "you," or "your") agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you and HireMeUp LLC, a limited liability company organized under the laws of Utah ("HireMeUp," "we," "us," or "our").
If you do not agree to all the terms and conditions of this agreement, then you may not access the Service. If these Terms are considered an offer, acceptance is expressly limited to these Terms.
The Service is offered and available to users who are at least 18 years of age and reside in the United States. By using the Service, you represent and warrant that you are of legal age to form a binding contract with HireMeUp and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Service.
2. DESCRIPTION OF SERVICE
HireMeUp operates a video-powered job matching platform that connects job seekers with employers through real human interaction. The Service allows:
For Job Seekers:
Creation of video profiles to showcase skills and personality
Application to job postings with guaranteed employer responses
Direct communication with hiring managers and employers
Access to job opportunities in food service, retail, trades, and related industries
For Employers:
Posting job opportunities and requirements
Viewing video profiles and applications from job seekers
Direct communication with potential candidates
Access to hiring analytics and management tools
The Service is designed to facilitate connections between job seekers and employers but does not guarantee employment, hiring, or any specific outcomes from use of the platform.
3. USER ACCOUNTS AND REGISTRATION
3.1 Account Creation To access certain features of the Service, you must register for an account. When you create an account, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for maintaining the confidentiality of your account credentials.
3.2 Account Types The Service offers different account types:
Job Seeker Accounts:
Free Tier: Limited to 5 job applications per month
Premium Tier: Unlimited applications with enhanced features for $12.99 per month
Employer Accounts:
Basic Tier: Up to 3 active job postings for $99 per month
Scale Tier: Up to 10 active job postings for $149 per month
3.3 Account Responsibilities You are responsible for all activities that occur under your account. You agree to immediately notify HireMeUp of any unauthorized use of your account or any other breach of security. HireMeUp will not be liable for any losses caused by any unauthorized use of your account.
3.4 Account Termination You may terminate your account at any time by following the account deletion process in the App or by contacting customer support. HireMeUp may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
4. USER CONDUCT AND PROHIBITED ACTIVITIES
4.1 Acceptable Use You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:
In any way that violates any applicable federal, state, local, or international law or regulation
To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation
To impersonate or attempt to impersonate HireMeUp, a HireMeUp employee, another user, or any other person or entity
To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service
4.2 Employment Law Compliance IMPORTANT NOTICE: Users are solely responsible for compliance with all applicable employment laws, including but not limited to:
Title VII of the Civil Rights Act of 1964
Americans with Disabilities Act (ADA)
Age Discrimination in Employment Act (ADEA)
Equal Pay Act
Fair Labor Standards Act (FLSA)
Family and Medical Leave Act (FMLA)
State and local employment discrimination laws
Wage and hour laws
Worker safety regulations
Employers specifically agree to:
Comply with all equal employment opportunity requirements
Refrain from discriminatory hiring practices based on protected characteristics
Ensure job postings comply with applicable wage and hour laws
Follow proper interview and hiring procedures as required by law
Job Seekers specifically agree to:
Provide truthful and accurate information in applications and profiles
Comply with workplace policies and safety requirements
Report any suspected violations of employment law through appropriate channels
4.3 Prohibited Content Users may not post, upload, or transmit content that:
Contains false, misleading, or fraudulent information
Violates any third party's rights, including intellectual property rights
Contains discriminatory language or content
Promotes illegal activities or violates employment laws
Contains malicious code, viruses, or other harmful components
Harasses, threatens, or intimidates other users
5. INTELLECTUAL PROPERTY RIGHTS
5.1 HireMeUp Intellectual Property The Service and its original content, features, and functionality are and will remain the exclusive property of HireMeUp LLC and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
5.2 User Content License By posting, uploading, or submitting content to the Service ("User Content"), you grant HireMeUp a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Service and HireMeUp's business operations.
5.3 User Content Ownership You retain ownership of your User Content. However, you represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to grant the license described above.
5.4 Content Monitoring HireMeUp has the right but not the obligation to monitor and review any User Content. We may remove or modify User Content that violates these Terms or is otherwise objectionable, in our sole discretion.
6. PRIVACY AND DATA PROTECTION
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information when you use the Service. By using the Service, you agree to the collection and use of information in accordance with our Privacy Policy, which is incorporated into these Terms by reference.
7. PAYMENT TERMS AND BILLING
7.1 Subscription Fees Certain features of the Service require payment of subscription fees. All fees are stated in U.S. dollars and are non-refundable except as expressly provided in these Terms.
7.2 Billing and Payment Subscription fees are billed in advance on a monthly basis. Payment will be charged to your designated payment method on the date you subscribe and on each monthly anniversary thereafter. You authorize HireMeUp to charge your payment method for all fees incurred.
7.3 Price Changes HireMeUp reserves the right to change subscription fees at any time. Any price changes will be communicated to you at least 30 days in advance and will take effect at the start of your next billing cycle.
7.4 Refund Policy Subscription fees are generally non-refundable. However, you may cancel your subscription at any time, and the cancellation will take effect at the end of your current billing period.
8. DISCLAIMERS AND LIMITATIONS OF LIABILITY
8.1 Service Availability HireMeUp strives to maintain the availability of the Service but does not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or technical issues.
8.2 No Employment Guarantees IMPORTANT DISCLAIMER: HireMeUp is a platform that facilitates connections between job seekers and employers. We do not guarantee:
That job seekers will find employment
That employers will find suitable candidates
The accuracy of information provided by users
The quality or legality of job postings or applications
Compliance with employment laws by users
8.3 Third-Party Interactions HireMeUp is not responsible for the actions, content, information, or data of third parties, including other users of the Service. You release HireMeUp from claims and damages arising from or related to such third parties.
8.4 Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HIREMEUP LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.
9. INDEMNIFICATION
9.1 User Indemnification You agree to defend, indemnify, and hold harmless HireMeUp LLC, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
Your violation of these Terms or our Privacy Policy
Your use of the Service, including any data or content transmitted or received by you
Your violation of any rights of another party, including other users
Your violation of any applicable laws, rules, or regulations
Any content or information you submit, post, or transmit through the Service
9.2 Employment Law Indemnification CRITICAL PROTECTION CLAUSE: You specifically agree to indemnify and hold HireMeUp LLC harmless from any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

Violations of the Americans with Disabilities Act (ADA) and ADA Amendments Act
Violations of the Age Discrimination in Employment Act (ADEA)

Violations of the Family and Medical Leave Act (FMLA)
Violations of the Pregnancy Discrimination Act
Violations of the Genetic Information Nondiscrimination Act (GINA)
Violations of any other federal employment, labor, or civil rights laws
State and Local Employment Law Violations:
Violations of state and local employment discrimination laws
Violations of state and local wage and hour laws
Violations of state and local family and medical leave laws
Violations of state and local workplace safety regulations
Violations of any other state or local employment-related laws or regulations
Specific Employment-Related Claims:
Discriminatory hiring, promotion, or termination practices
Workplace harassment or hostile work environment claims
Wage and hour violations, including unpaid wages or overtime
Wrongful termination or retaliation claims
Failure to provide reasonable accommodations
Privacy violations in the workplace
Worker classification issues (employee vs. independent contractor)
Any other employment-related legal claims or regulatory violations
9.3 Scope of Indemnification This indemnification obligation applies regardless of whether HireMeUp had knowledge of or participated in the alleged violations. Users acknowledge that HireMeUp serves solely as a platform connecting job seekers and employers and bears no responsibility for the employment practices, decisions, or legal compliance of its users.
10. DISPUTE RESOLUTION AND ARBITRATION
10.1 Binding Arbitration Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Salt Lake City, Utah, before one arbitrator.
10.2 Arbitration Rules The arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. Judgment on the award may be entered in any court having jurisdiction.
10.3 Class Action Waiver YOU AND HIREMEUP AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
10.4 Exceptions to Arbitration Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or confidential information.
11. GOVERNING LAW AND JURISDICTION
These Terms shall be interpreted and governed by the laws of the State of Utah, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Salt Lake City, Utah, and the parties hereby consent to personal jurisdiction and venue therein.
12. TERMINATION
12.1 Termination by User You may terminate your account and stop using the Service at any time by following the account deletion procedures in the App or contacting customer support.
12.2 Termination by HireMeUp HireMeUp may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including but not limited to:
Breach of these Terms
Violation of applicable laws or regulations
Fraudulent, abusive, or harmful behavior
Extended periods of inactivity
Business or legal reasons
12.3 Effect of Termination Upon termination, your right to use the Service will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
13. MODIFICATIONS TO TERMS
HireMeUp reserves the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
14. GENERAL PROVISIONS
14.1 Entire Agreement These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and HireMeUp concerning the Service.
14.2 Severability If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will continue to be valid and enforceable.
14.3 Waiver No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and HireMeUp's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
14.4 Assignment You may not assign or transfer these Terms, by operation of law or otherwise, without HireMeUp's prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. HireMeUp may freely assign or transfer these Terms without restriction.
14.5 Force Majeure HireMeUp will not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, or government actions.
14.6 Electronic Communications By using the Service, you consent to receive electronic communications from HireMeUp. These communications may include notices about your account and information concerning or related to the Service.
14.7 Export Control The Service may be subject to U.S. export control laws and regulations. You agree to comply with all applicable export and re-export control laws and regulations.
